1. Introduction

These Terms of Service (“Terms”) set out the conditions under which you may access and use the website tinytales.club (the “Site”) and purchase personalised children’s books (the “Services”). By accessing the Site or by clicking “Buy Now” you agree to be bound by these Terms. If you do not agree, you must not use the Site or purchase a book.

2. About Us

The Site and Services are provided by Pinjatic LTD (trading as Tiny Tales Club), a company registered in England & Wales under No. 13405158. Registered office: 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom. Email: support@tinytales.club

3. Definitions

  • “Customer”, “you” : the adult placing an order.
  • “User Content” : any data (text, images, ideas) you supply.
  • “Content” : everything on the Site or in the finished book other than User Content.

4. Eligibility

You must be at least 18 years old and legally capable of entering into a contract. By submitting personal data about a child you confirm that you are the child’s parent or legal guardian (or have equivalent authority) and that you consent to our processing of that data.

5. Personal Data & Privacy

During the pre-checkout flow we collect:

  • Child’s first name, age, photo and interests (required);
  • “Sidekick” name, description and photo (optional);
  • Story idea or prompts (optional);
  • Delivery and payment details.

  • OpenAI, LLC (openai.com) – AI image & text generation;
  • Lulu Press, Inc. (lulu.com) – print-on-demand production and distribution;
  • Gelato ASA – print-on-demand production & global distribution.
  • Shopify Inc. – storefront hosting & secure payment processing.

Data may be transferred outside the UK/EEA under valid transfer mechanisms (e.g. SCCs). You retain ownership of User Content but grant us and our processors a worldwide, non-exclusive, royalty-free licence to use it solely to produce and deliver your order and to provide support.

6. Intellectual Property

All Content (including AI-generated text and illustrations) is owned by or licensed to Pinjatic LTD. Personalised books are supplied for private, non-commercial use only. You may not reproduce, resell or exploit any portion without our prior written consent.

You warrant that User Content does not infringe any third-party rights and will indemnify us against any loss arising from breach of this warranty.

7. Ordering Process

  1. Click “Buy Now” and complete the data-entry flow.
  2. Review and correct your inputs before payment.
  3. On successful payment we email an order confirmation; a binding contract is then formed.

Please check spellings carefully — the book is generated exactly as you enter them.

8. Personalised Goods – Cancellations & Returns

Under UK Consumer Contracts Regulations 2013 and the EU Consumer Rights Directive, the 14-day “cooling-off” period does not apply to goods “made to the consumer’s specifications or clearly personalised.” Similar exemptions exist under Australian Consumer Law and most US state laws.

  • Before production begins (usually within 1 hour): email us to cancel for a full refund.
  • After production begins: orders cannot be cancelled or refunded unless the item is defective or we fail to follow your instructions.
  • Report defects within 14 days of delivery with photos. We will reprint or refund at our discretion.

Your statutory rights under applicable consumer-protection laws remain unaffected.

9. Pricing & Payment

Prices shown include applicable VAT/GST/sales tax unless stated otherwise. Delivery fees are displayed at checkout. We reserve the right to change prices at any time, but such changes will not affect confirmed orders.

10. Delivery

Production and shipping times quoted are estimates. We are not liable for delays outside our reasonable control (e.g. carrier or customs delays). Risk passes to you on delivery; title passes once full payment is received.

11. Acceptable Use of the Site

You must not :

  • Violate any law or regulation;
  • Upload unlawful, infringing, hateful, harassing or obscene material;
  • Transmit viruses or malicious code;
  • Attempt to gain unauthorised access to the Site or our systems.

We may suspend access or cancel orders for misuse.

12. Disclaimers

The Site and Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. AI-generated content may contain errors or inconsistencies; you acknowledge this risk.

13. Limitation of Liability

Nothing in these Terms limits liability for death, personal injury, fraud or any matter that cannot be excluded by law. Subject to that, our total liability arising out of or in connection with any order will not exceed the amount you paid for that order, and we will not be liable for indirect or consequential losses.

14. Indemnity

You agree to indemnify and hold harmless Pinjatic LTD, its directors, employees and agents from any claim or loss arising from your breach of these Terms or your misuse of the Site or Services.

15. Third-Party Links & Services

The Site may link to third-party sites. We are not responsible for their content or privacy practices. Your dealings with third parties (including Shopify, payment providers, carriers) are solely between you and those parties.

16. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted here with a new “Last updated” date. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

17. Governing Law & Jurisdiction

These Terms and any contract of sale are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers resident in the EU/EEA/CH/UK may also bring proceedings in their home jurisdiction under mandatory consumer-protection rules.

18. Alternative Dispute Resolution

If we cannot resolve a complaint, eligible UK/EU consumers may use the EU Online Dispute Resolution platform atec.europa.eu/consumers/odr. We are not obliged to participate in ADR and may decline to do so.
